Corporate Restructuring

Our corporate restructuring services address the capital structure of the business and focus on the changes needed to allow the business to be viable going forward. These services include work to restructure out-of-court and all facets of bankruptcy. We generally work on behalf of the company’s management through restructuring and in bankruptcy situations. However we also serve secured creditors in the workout process and the unsecured creditors committee in bankruptcy.

From the context of the advisor to a debtor, our goal in restructuring a business is to maximize the recovery of all stakeholders and there is no clear cut single method that can be employed to achieve this result. In general, we prefer to address restructuring out of court before settling for Bankruptcy Court protection because experience suggests that maximum recovery can be achieved with cooperation outside of Bankruptcy Court.

We assist the company’s management and counsel in preparing a plan for restructuring by understanding the rights of all creditors and helping formulate the plan that gets everyone in the best position. We then assist management in negotiating the plan with the creditors and then administering the plan. Once administered, we assist management in periodic financial reporting to its stakeholders, then administering the plan, which includes assisting management in periodic reporting to its stakeholders.

If bankruptcy is required to restructure, we prefer to assist in prepackaging the plan prior to the filing to limit the time until plan confirmation. We assist the debtor in possession by helping them plan for bankruptcy, providing administrative assistance, providing financial reporting services and serving as a financial advisor during the plan development and confirmation process.
